Will of Peter Lelliott of West Grinstead 1843

This is the last Will and Testament of me Peter Lelliott of West Grinstead in the County of Sussex Yeoman First I direct all my just Debts Funeral and Testamentary Expenses to be paid and discharged by my Executors hereinafter named as soon as conveniently be after my decease and subject to the payment there I bequeath all the personal Estate of which I may die possessed consisting principally of Four hundred pounds secured to me on a promissory Note from my son Henry Lelliott unto my Nephew Peter Lelliott of Steyning in the County of Sussex Gardener and my Friend Zaccheus Steer of Steyning aforesaid Postman their Executors Administrators and Assigns respectively Upon Trust to permit and suffer my dear wife Mary during her life to receive and take the Interest and Annual Proceeds thereof. And from and immediately after her decease. Upon further trust to convert and get in my personal Estate and the Monies to arise from such conversion to pay distribute and divide the same unto and equally amongst my eight Children (namely) Mary Nichols Widow, Maria the Wife of Valentine Chaplin Rhoda the wife of Benjamin Marner, Rebecca Lelliott Spinster, William Lelliott and Eleanor Lelliott Spinster Lucy the wife of Charles Matthews and the said Henry Lelliott deducting twenty pounds from the Share of my said Daughter Mary Nichols (which Sum I have advanced to her in my lifetime) and divide the said Sum of twenty pounds equally amongst my other seven Children hereinbefore named in augmentation of their original Shares in a course of distribution according to the Stocks and not to the number of individual objects and so that the Issue of deceased Children may take by way of substitution the Share or respective Share only as well original as augmented which the parent or respective parents would if living have taken on their attaining their respective ages of twenty one years or day of Marriage And I empower my said Trustees to apply the whole or any part of the contingent Share of the respective Issue of such Children aforesaid in or towards their respective maintenance or otherwise for their respective benefit And I direct that the respective Receipts alone of my said Daughters shall be a good and effectual discharge for the same notwithstanding Coverture. And I empower my Trustees and Executors or the Survivor of them to give receipts for all Monies and Effects to be paid or delivered to them by virtue of my Will and declare that such Receipts shall exonerate the persons taking the same from all liability to see to the application or disposition of the Money or Effects therein mentioned And I exempt each of my said Trustees and Executors from liability for Losses occurring without his own wilful default and authorize him to retain and allow to his Co Trustee and Executor all Expenses incidental to the Trusteeship. And I appoint the said Peter Lelliott my Nephew and Zaccheus Steer to be Executors of my Will Witness whereof I the said Peter Lelliott the Testator have hereinto set my hand and seal this fifteenth day of June One thousand eight hundred and forty two. The Mark and Seal X (SS) of Peter Lelliott Signed sealed published and Declared to the above named Peter Lelliott the Testator as and for his last Will and Testament the same having been previously read over to him and he appearing to understand the same in the presence of us who in his presence at his request and in the presence of each other have hereunto subscribed our names as Witnesses  —  Witness Thomas Stringer his Mark X,  James Laker his mark X


This will was proved 22nd day of April 1843 before the Revd Tho[ma]s Brown Clerk Surrogate by the Oath of Peter Lelliott one of the Executors named therein (Zaccheus Steer the other Executor having renounced) To whom a day was given for exhibiting an Inventory
