Will of Martha Lellyett of Leigh 1858

This is the last Will and Testament of me Martha Lellyett of Leigh in the parish of Warblington in the County of Southampton Widow I devise and bequeath unto my Grandson Robert Lellyett of Croydon in the County of Surrey Veterinary Surgeon all my real Estate whatsoever and wheresoever And also all my personal estate Estate and Effects to hold receive and take the same respectively unto and to the use of the said Robert Lellyett his heirs executors administrators and assigns according to the several natures or qualities thereof respectively Upon trust as to all my said real Estate and such part of my said personal Estate as shall be of a saleable nature as soon as convenient after my decease to sell the same by public auction or private contract with power to buy in to rescind or vary any contract and to resell and to convey and assure such parts of my said Estates as from time to time shall be sold in such manner as the respective purchasers shall direct And I declare that such purchasers respectively shall be exonerated from all responsibility in respect of the application of the monies paid by them to the trustee or trustees of this my Will And I declare that my said trustee or trustees shall stand possessed of the monies to be produced by such sale or sales and also of all other the monies to and or be received by him or them under or by virtue of this my Will In trust in the first place to pay all my just debts funeral and testamentary expences and the expences attending the said sale or sales and do and shall in the next place stand possessed of the residue or surplus of the said trust monies In trust for and to retain pay and divide the same unto and equally between himself the said Robert Lellyett and such of his brothers and sisters as shall be living at my decease to and for his and their own respective absolute use and benefit I give and devise all the messuages lands tenements and hereditaments vested in me as trustee or mortgagee unto the said Robert Lellyett his heirs and assigns Upon and subject to the trusts and equities for the time being affecting the same hereditaments respectively And I do hereby nominate and appoint the said Robert Lellyett Sole Executor of this my Will And I revoke all former Wills by me at any time heretofore made In testimony whereof I the said Martha Lellyett the Testatrix have to this my last Will and Testament contained in two sheets of paper set my hand and seal that is to say my hand to the sheet hereto annexed and my hand and seal hereto this seventh day of april in the year of our Lord one thousand eight hundred and fifty six  —  Martha Lellyett Seal  —  Signed sealed published and declared by the said Testatrix Martha Lellyett as and for her last Will and Testament on the day of the date in the presence of us present at the same time who in her presence and at her request and in the presence of each other have here unto subscribed our names as witnesses  —  Wm George Solicitor Portsea  —  Harriott Freeman   Stoneham Bedhampton


Proved at London 17th May 1858 by the oath of Robert Lellyett the Grandson the sole Executor to whom admon was granted


On the 17th day of May 1858 the Will of Martha Lellyett late of Leigh in the Parish of Warblington in the County of Southampton Widow deceased, who died on the 11th day of February 1858, at Leigh aforesaid was proved in the Principal Registry of Her Majesty's Court of Probate, by the Oath of Robert Lellyett of Croydon in the County of Surrey Veterinary Surgeon the Grandson the sole Executor therein named he having been first sworn duly to administer
