Will of Ann Lillyott of Brighton 1837

This is the Last Will and testament of me Ann Lillyott of 2 Upper Bedford Street Brighton in the County of Sussex Widow First I will order and direct that all my just debts funereal expenses and the expenses of proving this my will be paid and discharged by my Executors hereinafter named as soon as conveniently may be after my decease And I give and bequeath unto my brother Thomas Geere of Rottingdean in the said County of Sussex Officer in the Customs and my Sisters Sarah Geere of the same place Spinster Susannah Geere of Grove Terrace Saint John's Wood London Spinster and Eleanor Geere of the same place Spinster the interest dividends and proceeds of All such sum or sums as I may have in the Parliamentary stocks or Public funds of Great Britain at the time of my decease to hold the same together with all such dividends as may be due at the time of my decease unto my said Brother and Sisters equally in equal shares & proportions share and share alike and to be taken and enjoyed by them for and during the time of their respective natural lives and as and when any or either of them my said brother and sisters shall depart this life then the part share and proportion of such one or more so dying in the interest dividends and proceeds of such my funded property shall go and belong to the survivors and survivor of my said brother and sisters and from and after the decease of the last survivor of my said brother and sisters then I give and bequeath all and every the principal monies the interest dividends and proceeds of which I have given them for life and the life of the survivor unto my Nephew Henry Geere one of my trustees and executors hereinafter named and his brothers and sisters that is to say Thomas Geere of Stratford in the County of Essex Timber Merchant George Geere of the same place Timber Merchant John Geere now or late of Blackwall London Mariner Charles Geere of the same place Ship Carpenter Sarah the Wife of the Reverend Mr Anderson of Manchester Dissenting Minister Ann Geere of Blackwall aforesaid Spinster Elizabeth Geere of the same place Spinster the Children of my late brother Henry Geere sometime since of Blackwall aforesaid And to George Geere now or late of Bermondsey in the County of Surrey Mariner the son of my late brother George late of the same place Ship builder deceased and to their respective executors admors and assigns in equal shares and proportions share and share alike as tenants in common and not as joint tenants and in case any or either of my said Nephews and Nieces shall happen to depart this life in my lifetime or in the lifetime of my said brothers and sisters then the part share and proportion of such one or more so dying shall go and belong to the survivors and survivor of my said nephews and nieces who may be living at the decease of the survivor of my said brothers and sisters is equal shares. And I give and bequeath my Clock and case to James Parker of Poynings in the County of Sussex Servant the Son of Henry Parker of the same place Labourer and Maria his Wife who was the niece of my late husband James Lillyot to be delivered over to him immediately on my decease Also I give and bequeath to Elizabeth Geere of Brighton aforesaid Spinster the daughter of my late Cousin Charles Geere of Newhaven deceased my folio Bible with a Commentary of the Reverend John Malham to be delivered over to her immediately on my decease And as to all my messuages or tenements buildings ground and hereditaments and real estate whatsoever and wheresoever and whether in possession reversion remainder or expectancy or otherwise howsoever And all the rest residue and remainder of my Personal estate whatsoever and wheresoever and of what nature or kind soever and wheresoever the same may be found at the time of my decease. I give devise and bequeath the same and every part thereof with their and every of their appurtenances unto my sisters the said Sarah Geere an Susannah Geere my said Nephew Henry Geere of Limehouse near Blackwall in the County of Middlesex Victualler and my friend William Dumbrell of Rottingdean aforesaid Farmer to hold the same to them their heirs executors admors and assigns according to the nature and quality thereof But upon the trusts nevertheless and to and for the ends intents and purposes hereafter mentioned expressed and declared of and concerning the same / that is to say / Upon trust that they my said trustees or the survivors or survivor of them or the heirs executors or admors of such survivor shall and do with all convenient speed after my decease sell and absolutely dispose of the said messuages or tenements buildings ground and all other my real and personal estates and efforts so devised to them and that either by Public Auction or by Private Contract and either together or in parcels at their or his discretion unto any person or persons whomsoever for the most money that can be reasonably had or gotten for the same and shall and do convey and assure the same unto the purchaser or respective purchasers thereof and his her or their heirs executors admors and assigns or as he she or they shall respectively direct or appoint and shall and do by with and out of the monies to arise by such sale or sales in the first place pay and discharge the costs charges and expences of making out the titles to the said premises and of preparing for making and completing such sale or sales and from and after payment thereof and the payment and discharge of all my just debts funeral expences and the expences of proving this my will and deducting and retaining ten pounds to each of them my trustees for the trouble they may have in the execution of this my Will which I give to them then shall and do divide the clear net monies then remaining in their hands into two equal moieties or half part And as to one equal moiety or half part of such residue I give and bequeath the same to and among them my said nephews and nieces Henry Geere Thomas Geere George Geere John Geere Charles Geere Sarah Anderson Ann Geere and Elizabeth Geere Children of my deceased brother Henry Geere and George Geere the son of my late brother George Geere their respective executors admors and assigns equally in equal shares and proportions share and share alike as tenants in common and not as joint tenants and if any or either of them my said nephews and nieces shall depart this life in my lifetime then the part share and proportion of such one or more so dying shall go and belong to the survivors and survivor of my said nephews and nieces who may be living at the time of my decease and as to the other equal moiety or half part of the general residue of my said Estate and Effects I give and bequeath the same to Catharine the Wife of John Coles of Newtimber in the County of Sussex Labourer who was a nephew to my said late husband George Coles of Lewes in the same County Taylor James Coles of Brighton aforesaid Servant William Coles late of Lewes aforesaid Taylor Maria the Wife of the said Henry Parker of Poynings aforesaid Labourer and Sarah Coles of Cadogan Place Chelsea Servant also Nephews and Nieces of my said late dear husband James Lillyott and to their executors admors and assigns in equal shares and proportions share and share alike as tenants in common and not as joint tenants And if any or either of them the said Catharine Coles and the said nephews and nieces of my said late husband shall happen to depart this life in my life time then the part share and proportion of such one or more so dying shall go and belong to the survivors and survivor of the said persons who may be living at the time of my decease And I expressly declare that the receipt of the said Catharine Coles shall be deemed and taken to be a good and sufficient discharge to my said trustees and executors for the share payable to her alone and independent of her said husband and that the same shall be paid into her own hands and shall not be liable to the controul debts or interference of the said John Coles her said husband And I do hereby declare that the purchaser or purchasers of all or any part of my said messuages or tenements buildings lands grounds hereditaments and premises and real and personal Estate and Effects shall not be answerable or accountable or be obliged to see to the application of the purchase monies thereof or of any part thereof or be liable to be called upon for the nonapplication or misapplication of such monies or any of them or any part thereof but that such purchaser or purchasers and his her or their heirs executors and admors and all and every the said trust Estate and Premises and parts of shares thereof and every part of the same shall be fully and finally discharged therefrom upon payment of such purchase monies unto my said trustees and trustee for the time being and that the said trustees named in this my Will or any or either of them shall not be answerable or accountable for any more of the said trust monies than shall come to their or his hands nor with or for any loss or deficiency that may happen thereto or to any part thereof unless the same shall happen by or through their or his wilful neglect or default neither shall they or either of them be answerable or accountable the one of them for the other of them or for the acts deeds receipts payments or defaults the one of them for the other of them but each of them for himself only and only for his own Acts Deeds receipts payments and defaults and it shall and may be lawful to and for my said trustees and executors and each of them to retain and deduct to himself and them selves out of the aforesaid trust premises all such loss costs charges damages and expences which they or any or either of them shall or may sustain or be put unto for or in respect of this my Will or any matter or thing therein contained or relating there to And lastly I do hereby make ordain constitute and appoint my said Sisters Sarah Geere and Susannah Geere and the said Henry Geere and William Dumbrell to be Executors of this my Will And I do hereby revoke all former and other Will and Wills Codicil and Codicils by me at anytime heretofore made and do publish and declare this to be my last Will and Testament In Witness whereof I the said Ann Lillyott the Testatrix to this my last Will and Testament contained in six sheets of paper have set my hand and seal that is to say my hand to the first five sheets thereof and my hand and seal to this the sixth and last sheet the third day of Proved at London 31st July 1837 before the judge by the Oaths of Sarah Geere and Susannah Geere Spinsters the Sisters Henry Geere the Nephew and William Dumbrell the Executors to whom Admon was granted having been first sworn /to wit / the said Sarah Geere and William Dumbrell / by Commission / and the said Susannah Geere and Henry Geere before the Worshipful Herbert Jenner Doctor of Laws and Surrogate duly to administer
