Will of John Lellyett of Havant proved 1794
In the Name of God Amen I John Lellyett of Havant in the County of Southampton Gunsmith and Silver Smith being in good health and of sound Disposing mind memory and understanding do make and declare this to be my last will and Testament in manner following that is to say First I Commit my Soul to God and my Body to the Earth also all that my Freehold Messuage or Tenament Farm Land Hereditaments and appurtenances whatsoever thereunto belonging situate lying and being at East Leigh in the parish of Warblington in the said County I give Devise and bequeath unto my Son John Lellyett his Heirs and assigns for ever chargeable nevertheless and I do hereby expressly Charge the same with the payment of one annuity or yearly Sum of Twenty pounds to my Daughter Mary the wife of Edward Holton to be paid her monthly for and during the term of her natural life to be paid into her own hands seperate and apart from her present or any future husband she may happen to marry with and whose script alone Notwithstanding her coverture shall be a sufficient discharge to my said Son John Lellyett for the same and immediately from and after the Death of my said Daughter Mary Holton I herby also charge my said Freehold messuage Lands and promises to and with the payment of four hundred pounds to be paid equally unto and among all and every the Child and Children of my said Daughter Mary as shall be living at the time of her decease share and share alike if more than one and if but one then the whole to such one and I do hereby also further charge my said Freehold messuage or Tenemant Lands Tenements and Hereditaments whatsoever so by me given and devised to my said Son John Lellyett to and with the several Legacies following that is to say Four hundred pounds to my Son William Lellyett Six Hundred pounds to my Daughter Ann the wife of Edward Pinnex and four hundred pounds to my Son Thomas Lellyett which three last several Legacies I will and desire maybe paid within six calender months next after my decease also all those my two several Copyhold messuage or Tenements Lands Tenements and Hereditaments whatsoever with the appurtenances situate lying and being Within the manors of Havant and Fleed I give devise and bequeath unto my said Son John Lellyett his Heirs and assigns for ever also all those my Copyhold Messuages or Tenements Lands Tenements and Heredit[ament]s whatsoever situate lying and being within the Manor of Prinsted in the parish of Westbourne in the County of Sussex now in the occupation of John Freeland and also all those my Copyhold Messuages or Tenements Land Tenements and Hereditaments whatsoever situate lying and being within and Holden of the manors of Emsworth and Warblington in the said County of South[amp]ton I give devise and bequeath unto my Son Thomas Lellyett his Heirs and assigns for ever according to the custom of th[_ _____ ] ever [ ____ ] also all that my Messuage or Tenement Shop Backside Garden and appurtenances hereunto belonging wherein I move dwell and all that piece or parcell of Land lying and being in Havant aforesaid called or known by name of the Orchard and also all those my two Backsides and appurtenances thereunto belonging situate lying and being in Havant aforesaid now in the several Tenures or occupations of Mrs Mason and Mrs Peats I give devise and bequeath unto my Son William his Heirs and assigns for ever also all my Household Goods plate and Household Linen and also all my Stock and Impliments in Trade of what kind or nature soever or be I give and bequeath unto my said Son William also all my Bonds Bills mortgages Ready Money and other my personal Estate not herein and hereby before by me given and bequeathed after payment of my Just Debts and funeral Expenses I give and bequeath unto my son William Lellyett and lastly I do herby Nominate Constitute and appoint my three Sons John Lellyett William Lellyett and Thomas Lellyett Joint Executors of this my last Will and Testament hereby revoking all former and other Will and Wills by me at anytime heretofore made In witness whereof I the said John Lellyett the Testator have to this my last Will and Testament contained in two sheets of paper to each sheet thereof set my hand and Seal the Fifteenth day of august one Thousand seven hundred and ninety three Jo[h]n Lellyett/SS/ — Signed sealed published and declared by the said John Lellyett the Testator as and for his last Will and Testament in the presence of us who in his presence and at his request and in the presence of each other have published our names as Witnesses hereunto — Geo Noody Longcroft — Mary Longcroft — George Combs
This Will was proved at London the nineteenth day of July in the year of our Lord one thousand seven hundred and Ninety four before the Right Honorable Sir William Wyme Knight Doctor of Laws master Keeper or Commissary of the prerogative Court of Canterbury Lawfully Constituted by the oaths of William Lellyett and Thomas Lellyett the Sons of the deceased and c[___]t the Executors named in said will to whom administration was granted of all and singular the Goods Chattels and Credits of the said deceased having been first Sworn by Commission duly to administer power reserved of making the Gift grant to John Lellyett the Son also of the said deceased and the other Executor named in the said will when he shall apply for the same
